Futura Contest Official Rules

To Enter and Qualify.

Starting from 12:01am EST (Eastern Standard Time) on August 6, 2010 – until 11:59 PM EST (Eastern Standard Time) on September 9, 2010, existing Members of the Futura Program can shop at participating PJ’s Pets and Pets Unlimited locations and scan their registered Collector Card at the check-out for a chance to win 1 of 5 Futura Cash Back Rewards prizes of $100 account credit. Limit 1 eligible in store transaction per day. Starting from 9:01am EST (Eastern Standard Time) on August 6, 2010 Members are invited to call 1-877-707-7387 in lieu of scanning their Collector Card to fill out a phone ballot. Limit of phone ballots of one/member.

Prize.

A total of 5 - $100 Cash Back account credits will be provided by the sponsors once confirmation by Sponsor of winning entrant and successful answering of skill testing question to the winner(s).

Eligibility.

The contest is open to all legal residents of Canada excluding Quebec, and has reached the age of majority in the province in which they reside on or before the Contest Closing Date.

Officers, directors, representatives, partners and employees of any participating PJ’s Pets or Pets Unlimited, its affiliates, or subsidiaries, their advertising, promotional, publicity, production or judging agencies, and all those living in the same household as the above individuals, are not eligible to enter.

All decisions of the contest judges are final.

Contest is governed by the laws of Ontario and the federal laws of Canada incorporated therein. Sponsor has the right to cancel or modify the contest rules at any time and without notice. The odds of winning depend on the number of eligible entries received.

Drawing and Awarding of the Prize.

Sponsor will conduct a random electronic prize draw on Friday, October 8, 2010 (the “Contest Draw Date”), at the location of 56 The Esplanade, Suite 220, Toronto ON M5E 1A7 at or around 9:30 a.m. EST from all valid entries received on or before the Contest Closing Date. The odds of being selected depend upon the total number of entries received.

All decisions by Sponsor on all aspects of this contest shall be deemed as final and binding in all respects. The 1st five complete eligible entries selected will represent the winning entries. This contest is subject to all applicable federal, provincial and municipal laws. No substitutions or transfers of prize will be allowed except for the Sponsor’s right to substitute prizes of equivalent value in the event of circumstances beyond the Sponsor’s control.

In order to claim the prize and be declared a winner, the selected entrant will be required to correctly answer, without assistance of any kind, a mathematical skill-testing question to be administered by email or telephone at a pre-arranged mutually convenient time.

Once the entrant has been declared a winner, entrant must complete and sign a declaration and release statement, in order to; confirm compliance with the rules and regulations, accept the prize as awarded, without substitution, release the Sponsor and its affiliated companies from any liability, as described more fully below, and consent to the use of his or her name, address (city and province), photograph, and likeness to announce the winner.

Failure by any selected entrant to complete, sign and return any of the aforementioned documents within 14 business days after notification is sent to the address or email address provided by the entrant, or the return of prize documents as undeliverable, may result in forfeiture of the prize and selection of an alternate winner in the sole discretion of the Sponsor. If a selected entrant cannot be contacted in a timely fashion, or if for any other reason the prize cannot be awarded, another contest entry will be randomly selected by draw until the prize has been awarded. Failure for the selected entrant to correctly answer the skill-testing question will result in disqualification, the forfeiture of his or her interest in the prize, and the random selection of a substitute winner from among all remaining eligible entries. Communication will be entered into only with selected entrants.

Limitation of Liability.

The winner agrees that (except where prohibited) Sponsor may use winner’s name, picture, portrait, likeness and voice for advertising and promotional purposes without further compensation. Sponsor, its promotional and advertising agencies, and all respective officers, directors, employees, representatives and agents shall have no liability and shall be held harmless by winner for any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of the acceptance, possession, use or misuse or prize or participation in this Contest, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event lawyer’s fees. Sponsor reserves the right, in its sole discretion to cancel or suspend part or all of this Contest should virus, bugs, non-authorized human intervention or other causes beyond the control of sponsor corrupt or impair the administration security, fairness or proper play of the Contest. In such event, Sponsor may award the prize in a random drawing from all eligible entries received up to the date of cancellation or suspension. Sponsor and its promotion and advertising agencies are not responsible for technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmission, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in the promotion of by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit a participant’s ability to participate in the promotion. Sponsor may prohibit an entrant from participating in the Contest or winning the prize, if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. Offer void where prohibited and subject to federal, provincial and local laws.

Sponsor is not liable for any lost or stolen entries or inability to process entries or any errors, damage, or negligence that may arise in connection with this contest.Personal Information. By entering this contest, each entrant consents to the collection, use and distribution of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Sponsor for the purposes of implementing, administering and fulfilling this contest. The Sponsor will not sell or transmit this information to third parties, except for the purposes of administering the contest. We use your personal contact information to administer contest, including contacting, announcing and promoting prizewinner.
